ACSi SiteBuilder Partner Program Agreement

Partner's Customers are referred to as Client/s or Customer/s in this contract. Partners are referred to as Partner or Reseller in this contract. A Partner is an Independent Contractor/Representative and not an employee of ACSi.

Section 1  

ACSi's Partner Program for SiteBuilder allows participating web designers, web developers, consultants, and others the opportunity to use ACSi services at discounted rates and to resell those services to end-user clients on a profit-making basis.  The Gold & Platinum Partners are wholly responsible for providing support to its Customers and ACSi will not deal with the Customer, unless problem is found within a database. Silver Level Customers will be supported by ACSI. 

ACSi will assign a username and password to the Partner to access ACSi Control Panel to create a Support Ticket to ask questions and receive tech support. You will be able to refer back to previous Support Ticket for the information you have previously requested. Support Ticketing will act as the first point of contact for any issues. Eligibility & Requirements

To qualify as a Partner, an applicant must:

  • Be an resident and headquartered in the United States; and
  • Be 18 years of age or older; and
  • Agree to this ACSi SiteBuilder Partner Program Agreement description and the terms and conditions; and
  • Submit a Partner Program Application that is reviewed and approved by ACSi; and
  • Pay the appropriate enrollment fees: FREE for Silver Partner Program or pay the $99 for Gold Partner Program or pay the $199 Platinum Partner Program.

Section 2 Partner Levels, Benefits and Discounts

ACSi will provide a Partner with a discount for their clients based upon Partner Level and product type. The Partner will resell SiteBuilder products at the fixed prices, coupon discounts will apply if submitted. The Partner may sell the applicable services (training, setting up of website for customer, updating, or content writing, etc) to the Customer at any price determined by the Partner. Silver level may NOT offer these services of training, setup of website, since they have no training on SiteBuilder. Silver level can distribute coupons and make commission on the coupons used by clients only. If you would like to offer these services, please feel free to contact us to upgrade to the Gold or Platinum level. 

Coupon

The Coupon Code is mandatory during customers sign up to receive commission.
Each Partner will receive a Coupon Code which will help us to associate the appropriate Customer website order with the Partner and to pay the Partner their appropriate commissions. This coupon and price determines the type of customer support given to clients and their web site. Each Partner has to state on their web site their fees and services that they offer, as well as their type of support and services and what their coupon number covers, which needs to be in accordance with this agreement.

Silver level

Cost to become a Silver Level is FREE. Receive $50 one-time commission on basic setup for a paid Customer website. Regular price of basic website is $375. When the Customer uses the Silver Partner Coupon the Customer will receive a discount off of the regular price, so the Customers price with use of the coupon for the basic website fee is $299 ($76 savings). Silver level partner will NOT receive fees/commission on additional services (modules, additional items, etc), only on basic SiteBuilder website setup fee.

Silver Partners will receive after application approval & payment: 
1. PDF marketing material with your Partner coupon code. 
2. Partner Support will be online ticket support only, through ACSi control panel.. Will not have access to the partners support forum. 
3. Client Support will be online ticket support only. No phone support. They will have access to support forum.

Gold level

Cost to become a Gold Level is $99. Receive $50 one-time commission on basic setup for a paid Customer website. Regular price of basic website is $375. When the Customer uses the Gold Partner Coupon the Customer will get a discount off of the regular price, so the Customers price with use of the coupon for the basic website fee is $225 ($150 savings). Gold level partner will NOT receive fees/commission on additional services (modules, additional items, etc), only on basic SiteBuilder website setup fee.

Gold Partners will receive after approval & payment: 
1. Website is included with Partner Signup, includes all modules. 
2. Website hosting at monthly regular price. (please see monthly fees at http://www.acsisitebuilder.com/pricing_info.php )
3. One month FREE hosting for every new paying customer that signs up.
4. PDF marketing material with your Partner coupon code. 
5. Partner Support will be online ticket support only, through ACSi control panel. Compete access to partners support forum. 
6. Client Support will be online ticket support for database errors only (not "How To" questions). Clients will need to contact their Gold Partner for "How To" questions. No ACSi phone support. They will have access to support forum. 

Platinum level

Cost to become a Platinum Level is $199. Receive $50 one-time commission on basic setup for a paid Customer website. Regular price of basic website is $375. When the Customer uses the Platinum Partner Coupon the Customer will get a discount off of the regular price, so the Customers price with use of the coupon for the basic website fee is $149 ($226 savings). Also Platinum level partner WILL receive flat rate commissions on most additional modules as well.

Platinum Partners will receive after approval & payment: 
1. Website is included with Partner Signup, includes all modules. 
2. Website hosting is only $25 flat rate monthly for all modules. 
3. One month FREE hosting for Partner for every new paying customer that signs up.
4. PDF marketing material with your Partner coupon code. 
5. FREE box business cards. 
6. FREE box of brochures – with your name, phone number, and web address. 
7. Referrals: you will be listed in our Partner Locator section. 
8. 1 Hour FREE Basic Phone Training – a $95 value & additional training at reduced rates. 
9. Forum Access – This is a private section, password protected area, where you will find additional marketing materials, newsletter, website tips, customer service tips, how to make more money & how to better service your customers. 
10. Partner Support will be both phone & ticket support through ACSi Control Panel. Phone support not to exceed 2 hours per month.
11. Client Support: Platinum customers will have access to support forums. Client can only make a Support Ticket for technical problems, no “How to” questions. All support is done through Platinum Partner, so the Partner can make more money for their services.
12. Custom Database Websites: If  a Platinum partner sells any custom websites, that partner will receive a 25% commission on the setup website rate only, not on hosting. Not on future changes customer does to their web site.

Payments:

  1. Commissions are not reoccurring on customers. Partners will be paid a portion of the upfront setup fee and possibly also per module upfront fees, depending on level of Partner.
  2. Checks will be cut one time a month. All clients you sign up on SiteBuilder have to be on account 60 or more days before payment will be made. Payments will be mailed by the 10th of each month, with the cut off date being last day of the calendar month before. All customers need to be paid in full, before a Partner can be paid on them. Any charge backs will reflect on check.
  3. Each Partner is considered an independent contractor and no taxes will be taken out. You will receive a 1099 tax form by end of January of following year.
  4. Charge Backs: Any customer charge backs, the Partners commission / check will be subtracted accordingly to the month that the charge back exists or will be adjusted out of the first check able to cut for Partner.
  5. If a client cancels their SiteBuilder account within the last pay period on which ACSi calculates the payments/commissions, commissions will be adjusted accordingly. The commission will not be paid on cancelled accounts or the commissions will be taken out of next check of partner if client cancelled within the term agreed upon (if partner was already paid).
  6. Partners will only be paid on accounts in good standing. No payment will be paid/applied to accounts that are past-due or for accounts that are cancelled before the conditions for payment are met. 
  7. Partner must maintain their Partner Contract. Fees are according to level.
  8. Payments will not be paid for accounts established through any channels other than as described herein. you will only be paid on Customers that sign up through the website: acsisitebuilder.com and use the coupon code. If the code is not used, you will not get the commission. We will give Partner one (1) business day after the website has been submitted to contact us through Support Ticket (Control panel) or by phone to give us your customer that forgot to use your coupon number. This will only apply to commission for Partner, not to Customer discount. Customer will not receive the discount if they did not use the coupon number at time of ordering or paying for web site.
  9. The Payment will be mailed to Partner at the address listed on Partner's account. Please keep address up to date. ACSi is not responsible for keeping Partner address up to date.
  10. Partner shall bear all taxes, duties, levies, and other similar charges (and any related interest and penalties), however designated or imposed on it as a result of the existence or operation of the Payment , including any income, sales, or use tax on profits which may be levied against it. Partner is an Independent Contractor/Representative.
  11. ACSi reserves the right to advertise specials below partner pricing.
  12. Partner will NOT receive any commission checks if they have any fees or invoice past due to ACSi. All fees need to be kept up to date to retain Partner status. ACSi may cancel Partnership with Partner at ACSi sole discretion if there are late payment issues.
  13. If a Partner does not fulfill contract and/or breaks any part of the contract. ACSi may immediately end Partner status and discontinue paying partner for commissions.
  14. Other restrictions may apply. Changes that are made for New Partners will be automatically be in force for ALL existing Partners. Partners are responsible to log in and check policy changes on web site. ACSi is not responsible for notifying Partners of changes. There is no "Grand Father Clause". Changes effect all Partners.

Section 3  Program Obligations

The Gold & Platinum Partner is wholly responsible for providing support to its Partner Customers. ACSi will provide support for clients of Silver Partner's only. This is to help Gold & Platinum Level Partners increase their sales  through support, updates, training, and maintaining clients web sites and charging them directly. Hosting will be paid directly from Customer to ACSI through repeat billing using credit card. Partners will not be paid directly by customer for hosting.

The Customers are also your clients and we highly recommend you make the relationship with your clients profitable and be available to charge them for training or if they don't want to keep it updated, you can charge them for maintaining their web site. You can also charge them for tech support.  

Silver Partners we recommend that you should not be offering Training and/or Support or any additional services or fees, since Silver Partners are not taking advantage of their own SiteBuilder website to learn and use the databases and have not gone through training themselves. Contact us if you would like to upgrade to Gold or Platinum Partner.

Contact Us

Contact ACSI through our control panel and create a support ticket. ACSi only gives phone support to Platinum Partners, (Phone support not to exceed 2 hours per month). If you utilize our Support Ticket system for support, it is more thorough, due to the fact that it keeps track of questions and answer for you to reference back to. ACSi's Customer Service department will provide the Partner with any non-sales related support; however the Partner's customers, except Silver Clients, are not permitted to contact ACSi directly, except through the clients Control Panel. Please notify your customers upfront of this policy, so you do not have upset customers.

Section 4  Partner Obligations:
Every Partner participating in the Program must comply with the following:

  1. Technical Support
    Level Gold and Platinum Partners
    Must provide its Customers with any needed support. The Gold and Platinum Partners may not direct its Customers to contact ACSi directly, except through control panel for database not working issues. The Partners may not provide its Customers with applicable ACSi account details to permit them to contact ACSi directly. ACSi will be billing the Customer directly for any/all hosting fees. ACSi may bill the Partner at ACSi's current standard rates for support provided to a Partner's Customer/s if the Partner has violated this provision.  Notify customer upfront of support contact information.
    Level Silver Partner: 
    Their Customers will be charged the highest rates and those partners will receive the lowest in fees and service. All Support is done through Control Panel only. Absolutely no phone support for Partner & for Customer. Their Customers may contact ACSi through their Control Panel for support,  for support of databases not working and for "how to" questions. 
  2. Product Labeling
    The Partner can not market ACSi SiteBuilder under their own label. ACSi solely owns and operates ACSI SiteBuilder and all modules and all functionalities. At this time and date, SiteBuilder is not designed to run under private labels. This may be available in the future. 
  3. Business Conduct
    The Partner must conduct its business with high levels of integrity and fair dealing. The Partner should maintain a reputation for fair dealing and customer service at the highest levels. We would like the partners to also dress presentable and professional.
  4. Terms of Service
    The Partner must abide by the provisions and policies of ACSi's. Please see http://companyinfo.acsiwebhosting.com/ for all the policies, only the appropriate policies will apply to SiteBuilder Website and hosting. These policies may be modified from time to time. The Partner should impose conditions of service on its Customers that are at least as stringent as those imposed by ACSi. Without limiting the foregoing, the Partner must cause its Customer to comply with ACSi's Acceptable Use Policy as the same may be modified from time to time. If any Partner customer violates the ACSi Acceptable Use Policy, ACSi may terminate or suspend the Hosting Services for such Customer. 
  5. W-9
    Payments/commissions will NOT be paid until Partner has a completed W-9 form on file with ACSi. Within thirty (30) days following enrollment in the Partner Program, Partner must complete and submit to ACSi a completed IRS Form W-9. ACSi will not make any payments to Partner until ACSi has received a completed Form W-9 from the Partner. The Form W-9 is located at: http://www.irs.gov/pub/irs-fill/fw9.pdf and, once completed, should be faxed to ACSi at 770-977-4986 or mailed. Send it attention: Accounting and please call to make sure ACSi received it, so your checks will not be hindered. If any information submitted by the Partner on the W-9 is incomplete, incorrect or inaccurate, payments (if any) due Partner may be delayed or withheld at ACSi's sole discretion. It is the Partner's responsibility to assure that ACSi has a complete and accurate Form W-9 on file.

Section 5 Right To Terminate

  1. Bad Accounts: If Partner has excessive bad accounts, ACSi has a right to terminate their Partnership with ACSi & SiteBuilder.
  2. False Account: If Partner is creating false accounts/customers, ACSi has a right to terminate immediately their Partnership with ACSi & SiteBuilder.
  3. Bad Business Practices: If Partner has bad business practices, ACSi has a right to terminate their Partnership with ACSi & SiteBuilder at ACSi sole discretion.
  4. Policies: If Partner is not following this contract or any of ACSi's policies, ACSi has a right to terminate their Partnership immediately with ACSi & SiteBuilder.

Section 6  Demo Sites

  • Are not available to you or your Customers after 30 days. They are automatically deleted, along with the content of the website. ACSi is not responsible for any lose of data, due to site deletion.
